To: Representative Offices of Foreign Traders in Vietnam

Clause 1, Article 32 of Decree No. 07/2016/ND-CP dated 25 January, 2016 of the Government on detailing the Commercial Law regarding Representative Offices or Branches of foreign traders in Vietnam, stipulates the following: “Before 30 January of each year, Representative Offices and Branches are responsible for submitting reports, according to the template provided by the Ministry of Industry and Trade, on their actitives in te previous year by postal mail to the licensing authority”.

Point c, Clause 2, Article 67 of Decree No. 98/2020/ND-CP dated 26 August, 2020 states that the act of “failing to submit reports, provide documents, or explain issues related to the activities of Representative Offices as required by the competent state management authority as prescribed” will result in administrative fines ranging from 10,000,000 VND to 20,000,000 VND. If organizations violate, the fine will be twice the prescribed fine for individuals based on Point b, Clause 1, Article 3 of Decree 17/2022/ND-CP.

 Therefore, Representative Offices of foreign traders in Vietnam shall submit the 2023 Activity Report using the BC-1 form of Circular No. 11/2016/TT-BCT and submit the report before the deadline of January 30, 2024 to the Department of Industry and Trade to avoid administrative fines.

Representative Offices of foreign traders in Ho Chi Minh City should submit the 2023 Activity Report online through the electronic information page of the Department of Industry and Trade at http://congthuong.hochiminhcity.gov.vn/bao-cao -hoat-dong-vpdd .
